1. Introduction

Welcome to Tropical Penguin (“TP”, “we”, “our”, “us”), a digital marketplace that helps players discover, purchase, and manage virtual goods and services. These Terms of Service (“Terms”) form a binding agreement between Tropical Penguin and every visitor, registered user, staff member, or partner (“you”).

By creating an account, accessing our portal, submitting an order, or using any service operated by Tropical Penguin, you confirm that you have read, understood, and agreed to these Terms as well as any policies referenced herein.

2. Eligibility & Accounts

You must be at least 18 years old (or have reached the age of majority in your jurisdiction) to create an account. If you access TP on behalf of a business, you warrant that you are authorized to bind that entity to these Terms.

You are responsible for safeguarding your login credentials, configuring two-factor authentication where available, and keeping your account information accurate. Any activity performed under your credentials is deemed to be authorized by you.

3. Transactions & Payment

All prices are displayed in the supported currencies listed on the site and may change without prior notice. Taxes, processing fees, or bank charges are your responsibility unless Tropical Penguin explicitly states otherwise.

You agree that purchase orders are final once payment is confirmed. Refunds, cancellations, or modifications are handled according to the applicable product category and regional regulations. For mock payments or experimental flows, Tropical Penguin may simulate a successful or failed transaction to help you test deposit and withdrawal behaviors.

4. User Conduct

You will not misuse the services by engaging in fraud, money laundering, resale of stolen goods, unfair competition, interference with platform security, or any other unlawful behavior. Tropical Penguin may review orders, suspend accounts, or withhold payouts if suspicious activity is detected.

When submitting content (reviews, chat messages, support tickets, etc.), you must ensure that it is truthful, lawful, and free of defamatory or hateful speech. We reserve the right to remove user-generated content and escalate severe cases to relevant authorities.

5. Intellectual Property

All platforms, images, code, brand assets, and other proprietary materials created or licensed by Tropical Penguin remain our exclusive property. You may not reuse or modify these materials without written permission.

Third-party brands (game titles, payment logos, partner badges) belong to their respective owners. Displaying them on the TP portal does not imply ownership or endorsement beyond the scope of our agreements.

6. Disclaimers & Limitation of Liability

Tropical Penguin provides services on an “as is” and “as available” basis. We do not guarantee uninterrupted access, compatibility with every device, or that every merchant listing will meet your expectations. To the fullest extent permitted by law, Tropical Penguin is not liable for indirect, incidental, or consequential damages arising from the use of our services.

If a dispute cannot be resolved through support channels, our total liability to you for any claim will be limited to the amount you paid for the specific transaction that gave rise to the claim, unless otherwise mandated by applicable law.

7. Suspension & Termination

We may suspend or terminate your access at any time if we reasonably believe you violated these Terms, applicable laws, or platform policies. You may terminate the agreement by closing your account; certain obligations (such as outstanding payments or disputes) will survive termination.

8. Governing Law & Dispute Resolution

Unless otherwise required by local consumer protection laws, these Terms are governed by the laws of the jurisdiction where Tropical Penguin is incorporated. All disputes shall be handled through good-faith negotiations; if unresolved, the dispute may be submitted to arbitration or competent courts as determined by the governing law.

Tropical Penguin may revise these Terms periodically to reflect new features, legal requirements, or business practices. The “Last Updated” date will indicate when changes become effective. Continued use of the services after the updated Terms are published constitutes your acceptance.
